General terms and Conditions of sale
These general terms and conditions of sale apply to Hector et Lola' s purchases of products which are sold through this website by: us, the Seller, HL sarl 126 Rue Etienne Marcel 93100 Montreuil France registered on the French trade register under the following number R.C.S bobigny 2007B07235, and an individual final purchaser - i.e. an individual acting outside of his/her professional activity.
The resale of products purchased on Internet is strictly forbidden.
Once you ordered it means that you have fully accepted these conditions, which are accessible at any time on the website and mostly when you confirm your order.
These general conditions is the only agreement between you and Hector et Lola. If a condition is not available, in this agreement, the customs in the mail order selling's industry in France would determinate this condition.

The prices are mentioned in euros every taxes included, but postage charges.
• Delivery in Metropolitan France or any other country member of the European Union :
The order would include every charges. The prices charges the VAT of order's date. Any change in the VAT rate will be reflected on product's prices.
• Delivery within DOM TOM (overseas departments and territories):
For products sent within DOM TOM, prices would automatically not include VAT at 19,6% on the bill. At the arrival of your parcel, the customer would comply to the country's laws and pay for the eventual taxes.
• Delivery outside the European Union:
For products sent outside the European Union, prices would automatically not include VAT at 19,6% on the bill. Import rights, state's taxes or customs dues may be established. These duties are not within the competence of HL Sarl.You will be held wholly responsible for these duties and should comply to the country's laws.
They depend upon the country of destination, parcel's weight and selected way for the transportation. They are accessible at any time on the website and mostly when you confirm your order.
Products remain the property of HL Sarl until full price payment.
Order
To enable us to process your order, you are invited to select the "confirm" option at the end of the ordering process. Also known as "double click". This confirmation of order constitutes an electronic signature, which has a handwritten signature value between the customer and Hector and Lola.
Every order signed by the buyer by "double click" implies full and irrevocable acceptation, which cannot be calling into question exception "warranty satisfaction" item and "product's availability". Otherwise, data registered by HL will constitute the proof of the whole transactions between HL and the customers.
You'll be delivered if the articles are available on stock. In case that you receive just a a part of your order, you'll be debited for it and not for the total amount.

You can pay online with your credit or debit card (Visa, Eurocard/ Mastercard, American Express), by Paytal and we accept cheque within France
"Every payment transaction are directly process through HSBC website, the most reliable secure payment systems available on the Internet: the SSL (Secure Socket Layer) . All of your credit card details are protected and encrypted before they are sent for processing and are never kept on our website. Your credit card is debited at the time of the secured transaction in the currency of the order.
Our products are insured until delivery.

These delivery times could be changed in periods of strong request.
However HL Sarl would do his very best for respect these delays and satisfy all our customers.
Delivery may occur in the event of an agreement from the customer (in the order form), from payment centre HSBC (trade agreement) and from HL Sarl.
HL Sarl reserves the right to cancel any order placed by a customer with whom it has a dispute concerning a current or prior order.
HL Sarl could not be held responsible for direct or indirect consequences of the cancellation of an order or a delay in the delivery for any reasons whatsoever, in particular in the event of a strike of the postal services or transports in general. These delivery times are given as an indication only and should they be longer, this is not a valid reason to claim damages, refuse delivery or cancel the order.

If you are not satisfied with an item, just send the parcel back to us within 15 days of the delivery date together with the original receipt, in its original condition and packaging. Send it by registered post as we may not be responsible for any lost or unreturned items. You can ask for a full refund, exchange (size, colour or style), or credit note valid for one year. Please fill in the form at the back of the receipt to select your choice. Exchange is offered only in Metropolitan France and except products on sale or promotion .
For an exchange, delivery is free. All refunds are done within 3 weeks of the return of the parcel. For a refund, please provide your credit card details. For countries outside the European Union, please remember to indicate to the customs that this is a "return for non conformity".
Protection of personal data
Your personal data is required to process your order ,and at no time is it destined for sale, commercialization or hiring out to third parties. Your personal data remain confidential. Personal data will be only used by our services to process your order and communicate with you by mail or email.
You have the right to access, modify, rectify and refuse access to the information regarding your personal data in conformity with Law "computer data and liberty" dated 6 January 1978. You may ask us to do so by writing to us and indicating your email address, first name, last name and address.
- Property of the website and intellectual property
This website is a property of HL Sarl, holding all the intellectual property rights relative to the website. It is strictly forbidden to copy or download all or part of the website or its contents.
All material on the Hector et Lola Sarl website (including, without limitation, written texts, comments, works, illustrations, images, designs, photographs, logos and trademarks) are and shall remain the exclusive property of HL Sarl. Only a private use, reduced to the family circle, is authorized. Any other use is constitutive of counterfeit and sanctioned by the Intellectual Property Code. You may not reproduce, by any means or process, totally or in part, distribute, publish, transmit, create derivative works based on the catalogue Hector et Lola, modify or sell any such material contained on this website.
All of our designs are registered at the INPI (National Institute of Intellectual Property.
HL Sarl does not guarantee or warrant that the site or the information contained on the site are compatible with your systems or will be free of viruses, disabling devices or other code that manifests contaminating or destructive properties or any “force majeure” event. You are responsible for implementing safeguards to protect the security and integrity of your systems.
Photographs are not contractual. Hector et Lola Sarl cannot be held responsible for errors, especially typographical, or the possible variations in colour between the screen and reality.
Either party will not be considered either responsible for nor at fault for any delay or consecutive non-execution of goods resulting from a case of “force majeure”. Events are defined as “force majeure” if they meet the conditions defined by the "2ème chambre civile de la Cour de cassation".
These general terms and conditions of sale shall be governed by and construed in accordance with the French law. Only the French version of these general terms and conditions of sale can be used as evidence against Hector et Lola Sarl.
In the case of a litigation claim or of an out-of-court settlement, tribunals from Paris, France are the only competent body.
